The Honorable Kale Burdick sentenced a 40-year-old Inman man in five separate cases, in addition to binding him over to district court on felony charges and granting a continuance in a seventh case.

Joshua A. Carlson was sentenced to seven days in jail, with credit for three days previously served, and fined $500 on a charge of possession of marijuana, one ounce or less, third offense and was fined $100 for possession of drug paraphernalia, in the first case. The offenses were committed March 30, 2020. He was assessed $50 costs of prosecution.

The second case originally included nine counts, although two were dropped as part of a plea deal. He had entered no contest pleas to the remaining seven counts that were committed April 17, 2020.

Burdick sentenced Carlson to 45 days in the county jail for Count II, carry concealed weapon, first offense; seven days in jail and a $500 fine for Count III, possession of marijuana, one ounce or less, third offense; fines of $100 each for counts IV and V, both for possession of drug paraphernalia; 21 days in jail for Count VII, no proof of financial responsibility; 15 days in jail for Count VIII, no valid registration; and 15 days for Count IX, operate vehicle without proof of ownership. He was assessed $187 costs of prosecution. The jail sentences are to run consecutive, both to each other and to jail sentences in the other four cases.

Counts I and VI, possession of a deadly weapon by a prohibited person and driving during suspension/revocation, were dismissed by Holt County attorney Brent Kelly.

The third case resulted from Carlson’s failure to appear for court in the first two cases on June 9, 2020. Burdick sentenced him to 30 days in the Holt Count Jail, with credit for four days previously served, consecutive to the other jail terms, and $52 costs of prosecution.

In case four, Carlson was sentenced to 60 days in the county jail on Count II, obstructing a. peace officer, and 60 days, with credit for three days previously served, on Count III, resisting arrest. The jail terms are concurrent to each other, but consecutive to those in the other cases. He is also charged $50 costs.

Count I, driving during revocation/impound, was dismissed by Kelly, in exchange for the defendant’s no contest pleas. The crimes were committed Sept. 21, 2020.

In the fifth case, Carlson was sentenced to 60 days in the county jail, along with $50 costs for violating a harassment protection order Sept. 17, 2020. The sentence is to be served consecutive to the others. A second like count, alleged the following day, was dismissed by Kelly as part of a plea agreement.

Burdick granted a continuance, in the sixth case, until April 7. In that case, Carlson faces charges of driving during revocation/impound, first offense; willful reckless driving first offense; and criminal mischief, 0 to $500, all alleged Dec. 8, 2020.

Carlson waived his right to preliminary hearing in the seventh case and was bound over to Holt County district court on two of four counts alleged Dec. 14, 2020. According to the judge’s journal entry. He was bound over on Count I, stalking, a Class 3A felony, and Count IV, possession of a controlled substance. Burdick waived jurisdiction on two Class 2 misdemeanor counts, second-degree trespassing and violation of a harassment protection order, to the district court as well. Carlson was set for arraignment in the district court March 8. His attorney filed a written not guilty plea and waiver of appearance on his behalf March 5.
