Man accused of trying to flush drug bound over to district court

Donovan T. Colfack, 24, of Stuart waived his right to preliminary hearing on a Class 4 felony, possession of a controlled substance (methamphetamine) and was bound over to the Holt County District Court on June 18.

He is set for district court arraignment July 15. Bond posted April 17, in the amount of $10,000, 10% cash, is continued.

Martin Klein of Neligh was appointed to represent Colfack by the Honorable Kale Burdick on June 4, citing a conflict of interest for Holt County Public Defender Rod Smith, who was appointed counsel for a co-defendant, Drew Steskal.

Colfack was arrested April 12 by a Holt County deputy as law enforcement officers were serving a search warrant on a camper parked at a former gas station at the corner of Highways 20 and 45B in Ewing, according to an affidavit filed by the officer, Ed Nordby.

Nordby reported he observed Colfack leave the search site in his vehicle and travel to a Ewing convenience store, where he entered the restroom. Nordby reported that, with assistance from another deputy, he removed a plastic baggie from the toilet that contained rocks of a crystal substance that allegedly field tested positive for meth.
