Oakdale man faces felony domestic violence charge

Christopher Brady, 33, of Oakdale appeared in the Antelope County courtroom for first hearing on a Class 3A felony, third-degree domestic assault, second offense, alleged May 13.

If convicted of the felony, Brady faces up to a $10,000 fine and/or up to three years of incarceration. He requested court-appointed counsel. The Honorable Donna Taylor appointed Antelope County public defender Pat Carney and set preliminary hearing for June 5. Bond was set at $10,000, 10% cash, with order for no contact with the alleged victim.

“You can’t live with her,” Taylor told Brady. He must also provide written permission to the court from any person he resides with.

Preliminary hearing is set June 5. Brady was remanded to the custody of Antelope County sheriff Bob Moore, pending posting of bond.

Initially, according to an arrest affidavit filed by Nebraska State Patrol trooper Raymond Johnson, both Brady and Jamie Hawkins, were both placed under arrest May 13 in Elgin, after a passer-by reported an altercation. Hawkins was released after she answered questions at the county jail and charges were filed against Brady.

Janine L. Trobee, 54, of Johnstown appeared for arraignment on a charge of driving under the influence of alcohol, second offense, a Class W misdemeanor alleged May 2. If convicted of the offense, Trobee faces a potential $500 fine, from 30 days to six months in jail and 18-month revocation of driver’s license. If sentenced to probation, she would still face a $500 fine, 10 days in jail and the 18-month revocation.

Trobee requested court-appointed counsel. Taylor appointed Carney and set further arraignment June 5. Bond was continued, in the amount of $1,500, personal recognizance.

Marta Yanes-Cambara, 54, of Neligh, appeared for further arraignment on offenses in two cases, a Class 4 felony, issue bad check-aggregate, alleged June 2, 2023, and a Class 3 misdemeanor, disturbing the peace, alleged Jan. 3. Yanes-Cambara is represented by Carney. Perla Alarcon-Flory appeared as interpreter via Zoom.

Although no longer in custody, Yanes-Cambara, who has a history of failing to appear in court, was accompanied to court by staff from Antelope County Jail. Bond had been modified by Taylor on May 13, from $10,000, 10% cash, to $10,000 personal recognizance and Yanes-Cambara was released from jail.

Taylor sustained a defense motion requesting an evaluation to determine her competency to participate in court proceedings. She ordered an appointment be made with Dr. Klaus Hartman from the Lincoln Regional Center, via Zoom at the Antelope County Jail. Taylor instructed the sheriff’s office to notify Yanes-Cambara the day before and transport her to the facility for the evaluation.

“I don’t know if that’s the best way to conduct – we can try and if it doesn’t work can order her transported to Lincoln,” Taylor said.

A status hearing is set July 3.

Two defendants had their cases continued to July 3.

Ronald Dugal, 61, of Neligh, charged with a Class 3 misdemeanor DUS alleged Feb. 21, said he is still waiting to hear from officials in Massachusetts. He said it is the last obstacle to getting a Nebraska license.

A joint request for continuance was granted for Kris Sanderson, 57, of Norfolk, on a Class 4 felony, issuing a bad check, alleged Aug. 7, 2023. According to a complaint filed Feb. 14 by Smith, Sanderson is accused of writing a $36.69 bad check at Mr. S’s in Oakdale. The complaint indicated the charge is a felony due to a previous bad check conviction. Smith said he anticipates the case being changed to a misdemeanor and handled in county court. Personal recognizance bond of $5,000 is continued. He is represented by Carney.
