O'Neill man convicted of three counts sexual assault

Cody L. Kizzire, 38, of O’Neill entered no contest pleas to three charges in an amended complaint when he faced the Honorable Mark Kozisec in the Holt County district courtroom in O’Neill on March 11.

Kozisec adjudged Kizzire guilty, as charged, of the three counts committed between April 1 and June 30, 2022.

Kizzire had been charged with three Class 1D felony counts of sexual assault of a child. Kelly filed an amended complaint Feb. 12, reducing the charges to Class 2 felonies, sexual assault in the first degree, (subject another person to sexual penetration when the actor was 19 years of age or older and the victim was at least 12 but less than 16 years of age), pursuant to a plea bargain. Kelly also agreed to file no additional charges in the case. There was no agreement on sentencing, which is set June 3.

Kizzire was remanded to the custody of Holt County sheriff Ben Matchett, pending posting of bond in the amount of $150,000, 10% cash. He is represented by Holt County public defender Rod Smith.

The arrest affidavit in the case remains sealed due to the age of the victim.
