September 21, 2023

The Honorable Kale Burdick issued a warrant for the arrest of a 45-year-old North Platte man during Holt County court proceedings Sept. 5 in O’Neill.

Heath L. Foster did not show for arraignment on a charge of driving during revocation, alleged July 25 in O’Neill. Burdick revoked Fosters’ $ 1,000 personal recognizance bond and set a new bond of $3,000, 10% cash.

A written waiver of the right to a preliminary hearing, filed by Mark K. Brower, 33, of Omaha was accepted by Burdick Sept. 6 and Brower was bound over to Holt County district court on a Class 4 felony charge, possession of a controlled substance. Jurisdiction for two infraction counts, possession of drug paraphernalia and marijuana, was waived to the district court, where Brower is set for arraignment Sept. 25. Bond in the amount of $15,000, 10%, is continued.

Larry A. Walton, 57, of Columbus appeared in front of Burdick for sentencing on three counts committed July 14 in O’Neill.

Burdick fined Walton $250 on Count I, no proof of financial responsibility, a Class 2 misdemeanor; $75 for Count II, no operator’s license, a Class 3 misdemeanor; and $25 for Count III, failure to use child passenger restraint, an infraction. He was assessed $50 costs. Walton was self-represented.

Shawn D. Crist, 35, of O’Neill faced Burdick for arraignment on four counts committed June 22. He waived his right to counsel and pleaded no contest to all four counts. Burdick fined Crist $75 for Count I, no operator’s license; $250 for Count II, no proof of financial responsibility; $25 for Count III, no valid registration, a Class 3 misdemeanor; and $25 for Count IV, an infraction muffler violation. He was taxed $52 costs.

Three defendants chose to plead guilty by waiver.

Aaron K. Walters, 31, of Pipestone, Minnesota, was fined $25 for violating a permit requirement for an escort vehicle, a Class 3 misdemeanor committed July 18. He was cited near Cubby’s in O’Neill by a Nebraska State Patrol carrier enforcement officer.

Jennifer J. Farewell, 37, of O’Neill was fined for March 16 violations of O’Neill city code, $20 for allowing a dog to run at large and $30 for harboring a dangerous dog. She was taxed $49 costs.

Katherine A. Miller, 66, of O’Neill was fined for July 7 violations, $25 for failing to file a rabies certificate and $20 for allowing a dog to run at large. She was taxed $49 costs.
