O'Neill man sentenced for assaulting neighbor, reckless driving, DUI

 


The Honorable Kale Burdick handed down sentences when he presided from the bench in the Holt County courtroom in O’Neill on June 20.

Tanner J. Storjohann, 22, of O’Neill faced Burdick on three counts in an amended complaint filed by Holt County attorney Brent Kelly on April, 21, Count I, driving under the influence of alcohol, first offense, a Class W. misdemeanor; Count II, reckless driving, a Class 3 misdemeanor; and Count III, third-degree assault, a Class 1 misdemeanor. Storjohann entered guilty pleas on all three counts.

Burdick ordered a 12-month term of probation, including $390 in related fees and taxed him $105 costs of prosecution. In addition, on Count I, Storjohann was sentenced to pay a $500 fine, two days in the county jail, with credit for two days previously served, and his driver’s license was revoked for one year. He was fined $100 each on counts II and III.

According to an arrest affidavit filed by a Holt County investigator, Storjohann was arrested Dec. 3, 2022, after investigation into a report of an altercation in O’Neill, for throwing rocks at a 70-year-old neighbor, as well as nearly hitting the man with his vehicle.

The officer also reported, in the affidavit, “Storjohann was belligerent and obtuse during the entire booking-in process to the point that we had to stop the book-in process to put him in the jail cell to finish.”

Charges of terroristic threats and possession of open alcohol container were dismissed by Kelly when he filed the amended complaint. Storjohann was represented by Holt County public defender Rod Smith.

Teri R. Andresen, 35, of O’Neill appeared for sentencing on a charge of driving under the influence of drugs. Burdick ordered a six-month term of probation, including related fees of $210 and revoked her driver’s license for 60 days. Andresen was ordered to pay $55 costs.

Andresen pleaded no contest April 4 as part of a plea agreement. In return, Kelly dismissed two infraction counts, possession of marijuana and paraphernalia. Smith withdrew two defense motions, a motion in limine and a motion to suppress.

Andresen was arrested Oct. 28, 2022, after O’Neill police officers responded to a report of suspicious activity at a residence, including “come-and-go traffic indicative of the drug trade,” according to an arrest affidavit filed by one of the officers.

Jonathan M. Berman, 39, of Portage, Michigan, pleaded guilty by waiver and was fined $25 for speeding, 75 miles per hour in 65 mph zone; $300 for possession of marijuana; $100 for possession of drug paraphernalia; and was taxed $49 costs. Berman was cited May 3 by a Nebraska State Patrol trooper, on Highway 20, east of O’Neill.
