Orchard man faces SORA violation allegation

An Orchard resident appeared in the Antelope County courtroom in Neligh last week on a felony charge of failing to report his address to authorities.

Wade Silbernagel, also known as Wade Perry and Wade Silbernagel-Perry, 28, of Orchard faced the Honorable Donna Taylor on May 19, charged with a Class 3A felony, violating the Nebraska Sex Offender Registration Act. The defendant's request for court-appointed counsel had previously been sustained and Antelope County public defender Pat Carney appointed. The defendant had not yet contacted Carney, who was not in the courtroom. Taylor advised Sibernagel of potential penalties if he is found guilty, up to three years in prison and/or up to $10,000 fine. She set preliminary hearing at 11 a.m. June 7. Bond posted May 12, in the amount of $10,000, 10% cash, is continued.

According to an arrest affidavit, Nebraska State Patrol investigators arrested Silbernagel on May 11, after receiving an anonymous tip that he was residing in Orchard and had not registered with the Antelope County sheriff within three days, as required by SORA. Silbernagel's last registration in Nebraska was on May 28, 2014, but was listed on the Iowa SORA. The alleged move to Orchard violated that registration.

Silbernagel was convicted in Woodbury County, Iowa, in 2009, while he was a juvenile, of felony second degree sexual abuse, the victim a minor, according to the Nebraska State Patrol Sexual Offender Registry.

Silbernagel, who had been previously charged with SORA violation, allegedly told investigators that if he registers in a small town, he becomes "a piece of shit," according to the affidavit.

Taylor signed a warrant for the arrest of Jeffery A Reinke, 34, of Omaha. The warrant replaces one, issued in April 2018, that recently expired. The original warrant was issued after Reinke failed to appear March 2, 2018, on two counts alleged Jan. 1, 2018, leaving scene of property-damage accident and no operator's license.

Francis L. Brundle, 35, of Page failed to appear on a littering charge. Taylor ruled the county attorney may file motion and affidavit for an arrest warrant.

Several defendants chose to plead guilty by waiver and were fined for misdemeanor offenses.

Bor Reh, 35, of Omaha had four Class 3 misdemeanor violations to Nebraska Game and Parks Commission regulations. He was fined $100 for illegal use of a cast net and assessed $425 liquidated damages for the fish harvested; $100 for using a cast net in the closed portion of Verdigre Creek; $100 for possession of four largemouth bass under the 15-inch minimum size limit; and $200 for possession of nine brown trout (daily bag limit is five, along with $49 costs. He was cited April 29 by a NGPC officer below the Grove Lake spillway.

Pha Reh, 34, of Omaha was fined $100 for fishing without a permit, a Class 2 misdemeanor; $100 for use of cast net in closed area, a Class 3 misdemeanor; and $100 for illegal use of a cast net, a Class 3 misdemeanor; and he was taxed $49 costs. He was cited April 29 by NGPC officer below the spillway.

Christopher A. Palmer, 29, of Lincoln was fined $100 and taxed $49 costs for having no proof of financial responsibility, a Class 2 misdemeanor. Palmer was cited March 15 by an Antelope County deputy, near the intersection of 534 Avenue and 848 Road.

Tyler A. Bergman, 24, of Clearwater was fined $100 and $49 costs for a Class 3 misdemeanor, driving under suspension. Bergman was cited in Clearwater on April 19, by an Antelope County deputy.
