Holt County judge hands down sentences for DUIs

The Honorable Kale Burdick sentenced four individuals when he presided from the Holt Count court bench in O’Neill on Dec. 6, three of them for driving under the influence of alcohol.

Kalah M. Bergmann, 38, of Gretna was sentenced to a $500 fine, 10 days in the county jail, an 18-month term of probation and her driver’s license was revoked for 18 months for DUI (.08), second offense, a Class W misdemeanor. The jail time is deferred until Dec. 27 and she was given credit for one day previously served. Bergmann was taxed $115 costs of prosecution and ordered to pay probation fees totaling $670. Drug and alcohol testing may be conducted by sweat patch. As part of probation, Bergmann was ordered to notify Nebraska DHHS licensing division of the conviction.

The charge was reduced from DUI (more than .15), second offense, by Holt County attorney Brent Kelly in return for her guilty plea. Bergmann was represented by Holt County public defender Rod Smith.


Steven M. Hosmer, 58, of O’Neill was sentenced to a $500 fine, 10 days in the HCJ, with credit for one day previously served, and his driver’s license was revoked for one year for DUI (+.15). He was also fined $25 for failure to obey traffic control device (do not enter sign), an infraction. He pleaded guilty Oct. 11. Hosmer was arrested by an O’Neill officer Sept. 11. He was self-represented.

Clayton H. Dickau, 32, of Atkinson was sentenced to a $500 fine, a six-month term of probation and his driver’s license was revoked for 60 days for DUI (.08), first offense. Dickau was taxed $105 costs and ordered to pay probation fees totaling $210. Drug and alcohol testing may be conducted by sweat patch.

Dickau pleaded no contest Sept. 20, pursuant to a plea bargain, with Kelly reducing the charge from DUI (+.15). Dickau was self-represented.

Dickau was arrested by a Holt County deputy Aug. 11, west of Stuart. A preliminary breath test registered .244, with a Datamaster test result at the Holt County Jail, .231.

Donovan T. Colfack, 23, of Stuart was fined $150 and taxed $50 costs for no proof of financial responsibility, a Class 2 misdemeanor. Colfack pleaded guilty and Kelly dismissed a charge of no valid registration. Colfack waived his right to counsel. He was cited by a Holt County deputy Oct. 17 in Stuart.

Several defendants chose to plead guilty by waiver and were fined for their offenses.

Justin K. Becker, 32, of Mathis, Texas, was fined $25 and $49 costs for having no escort for a wide vehicle. He was cited Nov. 17 by a Nebraska State trooper on Highway 281, near Chambers Corner.

Daniel W. Nekolite, 36, of O’Neill was fined $100 and $49 costs for a deer regulation violation, failure to cancel deer tag. He was cited by a Nebraska Game and Parks officer Nov. 13.

Bo D. Peterson, 25, of Atkinson was fined $100 for careless driving, $50 for possession of open alcohol container and taxed $49 costs. He was cited Nov. 2 by a Holt County deputy, near 491st Avenue and 870th Road.

Brianna G. Vanderford, 25, of O’Neill was fined $50 and $49 costs for possession of an open alcohol container, an infraction committed Nov. 19 in O’Neill.

An Ogallala juvenile was fined $35 and taxed $49 for an O’Neill city ordinance violation, possession of tobacco, first offense.
