O'Neill man bound over on meth charge

Michael J. Long, 32, of O’Neill waived his right to preliminary hearing when he faced the Honorable Kale Burdick in the Holt County courtroom in O’Neill last week and was bound over to the Holt County district court on a Class 4 felony count of possession of a controlled substance, methamphetamine, alleged Dec. 27, 2021, in O’Neill. Long is set for arraignment in district court May 16. Long was cited for the felony and two infractions counts of possession of drug paraphernalia, by a Holt County deputy. Burdick waived jurisdiction of the infractions to the district court. Long is represented by Ronald Temple of Norfolk.

Avery A. Dilsaver, 41, of O’Neill appeared in county court for sentencing. Burdick sentenced Dilsaver to an 18-month term of probation for a conviction of contributing to the delinquency of a minor, a Class 1 misdemeanor committed June 10, 2021. The probation order includes 36 waivable days in the Holt County Jail, two days per month. (The court may waive the jail time each month, upon request of probation officer, April 29 jail sentence was waived). He was ordered to pay probation fees totaling $570 and $60 costs of prosecution. Terms of probation also include no unsupervised contact with any persons under the age of 18 except for members of his family; participate in dual diagnosis treatment and not discontinue without prior permission of probation officer in consultation with provider. Dilsaver was represented by court-appointed counsel Ashley Boettcher, who was appointed after public defender Rodney Smith declared a conflict of interest.

Sydney M. Abbott, 29, of O’Neill faced Burdick for a pretrial hearing on three counts. Pursuant to a plea agreement, Abbot pleaded no contest to two Class 3 misdemeanor counts of disturbing the peace, committed Feb. 27. Holt County attorney Brent Kelly dismissed a charge of third-degree domestic assault. Abbott was fined $100 on each count and taxed $50 costs of prosecution. Abbott was represented by Smith.

Jose A. Ponce, 21, of O’Neill waived his right to counsel and pleaded guilty to a Class 3 misdemeanor count, driving under suspension/before reinstated, committed Feb. 2, in O’Neill. He was fined $100 and taxed $50 costs. A warrant issued April 12 when he failed to appear for arraignment, was recalled by the court.

Jose F. Rodriguez, 24, of Evans, Colorado, pleaded guilty, by waiver, to five commercial motor vehicle violations. He was fined $25 for reciprocity-no trip/scale permit, $100 for failure to have/carry fuel permit; $50 for failure to stop and weigh; $25 for speeding, six to 10 miles over hour mover the posted limit; and $100 for no CMV-HOS log. He was assessed $49 costs. Rodriguez was cited by a Nebraska State Patrol carrier enforcement officer near the Highway 275/20 weigh station.
