ORDINANCE NO. 2022-3

VILLAGE OF CLEARWATER

AN ORDINANCE OF THE Village of Clearwater, NEBRASKA TO AMEND THE MUNICPAL CODE OF THE Village of Clearwater TO ADD A LOCAL LEGISLATION CHAPTER AND PROVIDE FOR THE CODIFICATION OF THE SAME; TO REPEAL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; TO PROVIDE WHEN THIS ORDINANCE SHALL BE IN FULL FORCE AND EFFECT; AND TO PROVIDE FOR THE PUBLICATION OF THIS ORDINANCE IN PAMPHLET FORM.

BE IT ORDAINED BY THE CHAIRPERSON AND Board of Trustees of the Village of Clearwater, NEBRASKA:

SECTION 1. That, in Ordinance No. 2014-6, the Board of Trustees of the Village of Clearwater, Nebraska, adopted its municipal code (hereinafter the “Municipal Code”).

SECTION 2. That the Municipal Code is organized into nine chapters and a general index.

SECTION 3. That the Board of Trustees desires to pass revisions to the Municipal Code that shall be codified in a new “Local Legislation” chapter.

SECTION 4. That the Municipal Code is hereby amended to include a new chapter entitled “Chapter 11: Local Legislation”. Said chapter shall be divided into the following articles to comport with the existing chapters of the Municipal Code:

Article 1 – Civil Administration

Article 2 – Commissions and Boards

Article 3 – Misdemeanors

Article 4 – Vehicles and Traffic

Article 5 – Business Regulations

Article 6 – Public Ways and Property

Article 7 – Public Utilities

Article 8 – Fire Regulations

Article 9 – Building Regulations

Article 10 – Cross-Reference Table

SECTION 5. That an ordinance enacted to add, amend, modify, or repeal a section of the Municipal Code shall be held by Village Clerk as a Slip Ordinance until the end of the calendar year. At the first regular meeting of the Board of Trustees of the calendar year, the Board of Trustees shall authorize via resolution the publication of a Cumulative Supplement to the Municipal Code, which shall incorporate all Slip Ordinances and prior revisions to the Municipal Code and shall revise the Cross-Reference Table of Chapter 11 to identify all sections of the original code that are amended, modified, or repealed by Chapter 11. The most recent Cumulative Supplement shall constitute Chapter 11 of the Municipal Code.

SECTION 6. That all ordinances or parts of ordinances in conflict be and the same hereby are repealed.

SECTION 7. That three-fourths of the Board of Trustees voted to suspend the requirement that this ordinance be read by title on three different days.

SECTION 8. That this ordinance shall be effective from and after its passage, approval and publication as provided by law.

SECTION 9. That this ordinance shall be published in pamphlet form and available for public inspection during normal village office business hours.
