Neligh woman sentenced for false reporting

Lisa M. Dugal, 56, Neligh, appeared in front of the Honorable Donna Taylor in the Antelope County courtroom in Neligh on Feb. 2 for pretrial conference on a Class 1 misdemeanor, false reporting. Dugal changed her plea to no contest, pursuant to a plea deal. In return, Antelope County prosecutor Joe Abler agreed to file no additional charges in the case and recommended a probation sentence. Taylor sentenced her to an eight-month term of probation, including related fees totaling $280 and $50 costs of prosecution. The charges stemmed from statements made July 15, 2021, during an investigation into allegations of false imprisonment and domestic assault. She was represented by court-appointed attorney Kyle Petersen of Tilden.

Aaron White, 47, faced Taylor on a charge of second-degree trespassing, a Class 3 misdemeanor. White changed his not guilty plea to no contest. Taylor found him guilty. Abler entered a motion to put off sentencing, in order to contact the victims. Taylor found that the victims are also victims in a pending Antelope County district court case and sentencing could proceed. She sentenced White to 45 days in the county jail, with credit for 30 days previously served, fined him $400 and assessed costs of $51, with $2 costs waived. White was represented by Antelope County public defender Melissa Figueroa.

Kathy S. Genia, 65, of Veblen, South Dakota, appeared for a preliminary hearing on a Class 4 felony, possession of hashish, and two misdemeanor counts, driving under the influence of drugs and possession of more than one ounce of marijuana. A plea bargain was announced. Abler reduced Count I to attempt of a Class 4 felony, a Class 1 misdemeanor, and there was a joint recommendation for jail sentences of 30 days, 14 days and seven days, respectively, all running concurrently. Genia pleaded no contest to the amended Count I and to counts II and III as charged. Taylor judged her guilty to all three counts and sentenced her to 30 days in the county jail on Count I, with credit for one day previously served, a $500 fine, six-month driver’s license revocation and seven days in jail on Count II (to be served consecutive to the jail ordered on Count I) and seven days in jail on Count III, concurrent to the others. Genia was remanded to the custody of Antelope County sheriff Robert Moore for execution of sentence. According to a probable-cause affidavit filed by Moore, she was arrested near the Antelope/Wheeler County line, west of Elgin on Sept. 11, 2021, after she “went off the road out of control.” He reported she had slurred speech and difficulty maintaining her balance at the time of her arrest. Genia was represented by Figueroa.

Daniel C. Hohrein, 43, of Oakdale appeared for sentencing on a count of driving under the influence of alcohol, first offense, committed Oct. 9. Taylor fined Hohrein $500, ordered him to serve an eight-month term of probation, including $280 probation fees, revoked his driver’s license for 60 days and assessed $109 costs of prosecution. He will be given credit on his fine for out-of-pocket expense, not to exceed $200, for court-ordered substance abuse evaluation. Hohrein was represented by Figueroa.

Tyler A. James, 21, of Oakdale, appeared for sentencing on a charge of leaving the scene of a Dec. 12, 2021, property-damage accident, in Oakdale. Taylor fined James $250 and assessed $50 costs. He was self-represented.

Anthony Williams, 30, of Wayne was granted continuance to Feb. 16, for sentencing on counts of third-degree assault and disturbing the peace, committed June 27, 2021, at a Clearwater concert. Bond posted June 30, 2021, in the amount of $4,000, 10% cash, is also continued. Williams is represented by Figueroa.

James A. Kreizel, 37, of Creighton was granted continuance of sentencing on a count of driving under suspension, a Class 3 misdemeanor committed July 6, 2021, near the intersection of highways 13 and 20. Kreizel is self-represented.
