Defendants fail to appear, warrants issued, bonds revoked

Warrants were issued by the Honorable Donna Taylor for two defendants who failed to appear in the Antelope County Court last Wednesday, Nov. 17.

Angela Flores, of Neligh failed to appear for a bench trial on a City of Neligh junk ordinance violation alleged Aug. 1. Taylor issued a warrant for Flores’ arrest, with a $1,500, 10% bond, after a motion was filed by Joe McNally on behalf of the city. McNally testified Flores had called his office 20 minutes prior to the scheduled trial, indicating she had to work. The attorney alleged he had seen her outside her residence less than an hour before the call.

Sada L. Carr, 35, of Norfolk, formerly of Oakdale, failed to appear in two cases. She was set for sentencing on a count of driving under suspension, a Class 3 misdemeanor committed Aug. 21, and for a hearing on a motion to revoke probation ordered by Taylor on Oct. 6 for second-degree forgery, a Class 1 misdemeanor committed last December. Taylor signed a warrant for her arrest in the first case, setting bond at $1,500, 10% cash. The judge ruled a warrant will issue if Carr fails to appear Dec. 1 in the second case.

Taylor granted motions filed by Antelope County prosecutor Joe Abler to revoke bond for two defendants who had failed to appear.

The judge revoked bond, in the amount of $1,500, 10%, for Matthew Jung, 38, of Norfolk, with the 10% posted May 3 forfeited. A warrant was also issued for Jung’s arrest, with a new $1,500, 10% bond.

Jung did not appear for the hearing. He failed to appear Sept. 1 for further arraignment on a Class 3 misdemeanor count of driving under suspension and three infraction counts, possession of marijuana, possession of drug paraphernalia and speeding, all alleged April 28, west of Plainview on Highway 20. On Nov. 10, Abler filed a new complaint, charging Jung with failure to appear on Sept. 1, a Class 2 misdemeanor. Jung appeared in court June 16, waived his right to counsel and requested a continuance, which was granted. He was again granted continuances July 21, when he cited lack of a ride to court, and when he appeared Aug. 4.

Taylor revoked bond and ordered the 10% cash paid by Casey N. Fulgium, 36, of Conroe, Texas, forfeited. The defendant’s court-appointed attorney, Martin Klein, was discharged from any further representation of Fulgium, who was not present at the hearing. He had failed to appear Oct. 6 for a pretrial hearing on a charge of domestic assault and a warrant was issued for his arrest.

Andrew Friesz, 22, of Norfolk failed to appear to show cause for not making timely payments on restitution to Nebraska Public Power District, as ordered in a 2018 case. Taylor ruled the county attorney may file contempt charges.

Russell L. Meyer, 63, of Orchard failed to appear for arraignment on charges of second-degree trespassing and disturbing the peace, both Class 3 misdemeanors. Taylor continued the case until Dec. 1, indicating a warrant will be issued if he fails to appear. Bond posted Sept. 10, in the amount of $3,000, 10%, is continued. Meyer is also scheduled for a status hearing Dec. 1 in another case, charging him with second-degree trespassing/defy order to leave, a Class 2 misdemeanor alleged May 1, with a different victim. Melissa Figueroa, his court-appointed attorney in that case, filed a motion to continue a pretrial hearing scheduled Nov. 17 and a jury trial, set for Nov. 22, citing she was unable to get in contact with Meyer. Bond, posted May 4 in that case is also continued, in the amount of $1,500, 10%.

James A. Kreizel, 37, of Creighton failed to appear for sentencing on a count of driving under suspension/before reinstated, a Class 3 misdemeanor committed July 6 near the intersection of highways 13 and 20. The defendant contacted the court, saying he was ill. Taylor continued sentencing to Dec. 1, indicating a warrant will be issued if he fails to appear again. He was granted a continuance of sentencing in October as well. Kreizel is self-represented.

Haiden M. Sleister, 18, of Oakdale, did not appear for a pretrial hearing on charges of third-degree assault, a Class 1 misdemeanor, and willful reckless driving, a Class 3 misdemeanor, both alleged Sept. 23 near the Oakdale lagoon. Figueroa requested a continuance, saying her client was ill. The hearing is continued to Dec. 1. Bond, in the amount of $5,000, 10%, posted Oct. 21, with condition that he reside with his mother and be home by 8 p.m. nightly, is continued as well.

Stephen E. Wood, 51, of Neligh failed to appear for arraignment on a charge of assault by mutual consent, alleged Oct. 17 at 301 J Street in Neligh. He contacted the court late in the day. Arraignment is continued to Dec. 1.

Aaron White, 47, Coleridge failed to appear for further arraignment on a Class 3 misdemeanor, second-degree trespassing, alleged Oct. 4. White called the court, requesting a continuance, stating he did not have the funds to travel to Neligh. Abler objected. Taylor granted a continuance until Dec. 1, ordering a bench warrant issued at 11 a.m. Dec. 1, if White does not appear. Bond, posted Oct. 21, in the amount of $5,000, 10%, is continued as well. White is represented by Figueroa.

A warrant was issued for White in a new case on Friday. He is accused of making terroristic threats.

Anthony Williams, 30, of Wayne failed to appear for a pretrial hearing on four counts alleged June 27, counts I and II, third-degree assault, Class 1 misdemeanors; Count III, obstruct government operations, also a Class 1 misdemeanor; and Count IV, disturbing the peace, a Class 3 misdemeanor. Figueroa requested a continuance. Taylor granted the request, stating a bench warrant will be issued if Williams fails to appear Dec. 1. Bond, in the amount of $4,000, 10%, posted June 30, is also continued.
