Orchard man accused of intent to deliver meth, theft

Justin M. Golter, 46, of Orchard faced the Honorable Donna Taylor in the Antelope County courtroom in Neligh on Oct. 20 for arraignment on four counts alleged Aug. 20, 2020.

Golter is accused of a Class 1D felony, possession of methamphetamine, with intent to deliver (two ounces); a Class 4 felony count, possession of meth; and two Class 4 felony counts of theft by receiving stolen property, $1,500 to $5,000.

Golter requested court-appointed counsel. Taylor adjudged him indigent and appointed the public defender’s office to represent him. She found probable cause for detention and reduced bond to $50,000, 10% cash, with condition, if he refuses drug test or tests positive, bond will return to $100,000, 10%. In addition, he must be at his mother’s residence between the hours of 8 p.m. and 6 a.m. daily. He was represented by Martin Klein of Neligh for purpose of bond review only.

A warrant was issued for Golter’s arrest Aug. 4, on a motion by Antelope County Attorney Joe Abler. He had initially been arrested by a Nebraska State Patrol officer in August 2020, on active felony warrants from Lancaster and Dodge counties. According to a probable-cause affidavit filed by the trooper this past August, a dump-box trailer and a Honda all-terrain vehicle, allegedly towed behind Golter’s pickup at the time of his initial arrest, were confirmed by NSP investigators as stolen in Platte County. During a post-arrest inventory of the pickup, the trooper alleges about two ounces of packaged meth was found, along with cash, a scale and a pipe with meth residue.

Golter was remanded to the custody of Antelope County sheriff Robert Moore, pending posting of bond.

Others appearing for arraignment included 21-year-old Breanna M. McNutt of Stanton, who faces a Class 3A felony count of third-degree assault on a police officer. Taylor found probable cause for McNutt’s detention and set bond at $10,000, 10%, with a stipulation that she reside with her parents or grandparents in Stanton County. Preliminary hearing is set Nov. 3. McNutt is represented by Frederick Bartell of Norfolk. She was remanded to the custody of Moore, pending posting of bond.

According to a probable-cause affidavit, filed by Antelope County deputy Shelby Keetle, McNutt was being booked into the Antelope County Jail on Stanton County charges Aug. 12, when she allegedly assaulted Keetle and broke the glass in a window of a jail cell. The deputy suffered injuries that required treatment at the emergency room.

Aaron White, 47, no address listed, appeared for arraignment on a Class 3 misdemeanor, second-degree trespassing, alleged Oct. 4. White requested court-appointed counsel. Taylor found him indigent and appointed the public defender’s office. The judge found cause for detention and set bond at $5,000, 10%, including an order for no contact with Kirk Brozek, Katherine Brozek, Lance Brozek or Diane Brozek. Further arraignment is set Nov. 3. White was remanded to Moore’s custody, pending posting of bond.

A warrant for White’s arrest was issued Oct. 6 and was served by Cedar County officials Oct. 12. An affidavit, filed by Antelope County deputy Lyle Juracek, alleges White arrived at a rural residence in northern Antelope County, walked on the porch, rang the doorbell, and looked in a window before leaving. Juracek said White had been served with “private property trespass orders,” referencing the property, by registered mail in 2018.

Daniel C. Hohrein, 43, of Oakdale faced Taylor for arraignment on a count of driving under the influence of alcohol, .15+, alleged Oct. 9. Hohrein requested court-appointed counsel. Taylor found him indigent and appointed the public defender’s office to represent him. Further arraignment is set Nov. 3. A $5,000 personal recognizance bond, filed Oct. 12, is continued as well.
