Third-time charm in jail sentence

A 23-year-old Blair woman was sentenced last week, for the third time for a 2018 conviction.

The Honorable Mark Kozisek sentenced Paige M. Korth, to two years in prison when he presided from the Holt County district court bench Aug. 2.

Blair was originally sentenced in October 2018 to a total of three years of probation for her convictions of driving under the influence – cause serious bodily injury, a Class 3A felony, and transporting a child while intoxicated, a Class 1 misdemeanor.

Four additional counts were dropped as part of a plea agreement.

The crimes were committed in October 2017.

Probation violations were filed in May 2019 and December 2020. She admitted the 2020 violation in March and a pre-sentence investigation was ordered by Kozisek. A warrant was issued July 8, after she failed to appear for sentencing June 28.

She turned herself in July 16 and posted a $5,000 cash bond. Kozisek sentenced her July 26, but the sentence was later vacated after breath test results indicated Korth was under the influence at the time of sentencing and further possible intoxication “by virtue of ingestion of controlled substances.” She was remanded to the custody of Holt County sheriff Ben Matchett and sentencing was continued to Aug. 2.

On the felony DUI count, Kozisek sentenced Korth to 24 months imprisonment under the jurisdiction of the Nebraska Department of Correctional Service, with credit for 30 days previously served; a $1,000 fine; payment of $330 accrued probationary fees; six-month revocation of her driver’s license, effective upon the date of release from prison; and 18 months post-release supervision. He sentenced her to six months in prison on the misdemeanor count, to be served concurrently.

Provided she loses none of her good time, Korth must serve 12 months, less 30 days, before attaining mandatory release.

She was remanded to the custody of Matchett to be taken for execution of sentence, to the Nebraska Center for Women at York.
