Two incarcerated men receive additional prison sentences

 


Two men were sentenced to prison by the Honorable Mark Kozisek in the Holt County district courtroom in O’Neill on Monday – melded to prison terms they were already serving.

Kozisek sentenced Joshua A Boettcher, 29, of Stuart to 12 months in the Nebraska Department of Corrections on each of two felony convictions of possessing controlled substances. The prison sentences are ordered concurrent to each other and to a sentence Boettcher is serving for Holt County crimes committed in July 2019.

In addition, Kozisek sentenced Boettcher to a 12-month term of post-release supervision, including program fees of $390, and he was taxed $137 costs of prosecution.

Boettcher, who appeared electronically from a Nebraska Department of Correctional Services location, had pleaded guilty to the two crimes as part of a plea agreement with Holt County prosecutor Brent Kelly. In return for the guilty pleas to possession of pregabalin and suboxone, Kelly dismissed a felony possession of methamphetamine count and two infraction charges, possession of marijuana and possession of drug paraphernalia. The crimes were committed Oct. 29, 2020, in O’Neill.

Boettcher was represented by Holt County public defender Rod Smith.

Justin Lindberg, 36, of Grand Island also appeared electronically from a department of corrections site, for sentencing in a case dating back to June 2020. He was convicted of an enhanced Class 3A felony count of driving under the influence of alcohol, third offense, more than 0.15, after reaching a plea deal with Kelly. In return for his guilty plea, three additional charges, a Class 3 felony count, driving while revoked from DUI, and two infractions, speeding and possession of open alcohol container, were dismissed.

Kozisek sentenced Lindberg to 18 months in a facility under the jurisdiction of the Nebraska Department of Corrections, concurrent to Hall County district court sentences he was serving. He was also fined $1,000; sentenced to 18 months post-release supervision, including $570 program fees; his driver’s license was revoked for 15 years and he was assessed $137 costs of prosecution.

Lindberg was arrested June 15, 2020, by a Nebraska State Patrol trooper, who was conducting a stationary patrol on 872 Road (Old Highway 108) east of O’Neill.

Lindberg was represented by Smith.
