Multiple DUI convictions send Texas man to prison

 


Donald E. Vickers, 55, of Electra, Texas, faced the Honorable Mark Johnson in the Antelope County district courtroom in Neligh last Wednesday for an enhancement hearing and sentencing on a felony driving under the influence of alcoholic liquor, third offense.

Johnson found prior DUI convictions were sufficient for Class 3A felony enhancement.

Johnson found Vickers was not a suitable candidate for probation, that a sentence less than incarceration would depreciate the seriousness of the crime and promote disrespect for the law, and that imprisonment is necessary for protection of the public. He proceeded to sentence Vickers to a determinate term, 30 months, in a facility under the jurisdiction of the Nebraska Department of Corrections, with 18 months of post-release supervision under the supervision of the Nebraska Probation Administration. Vickers was also fined $1,000 and ordered to pay $147 costs of prosecution. His driver’s license was revoked for 15 years.

Vickers, who was represented by Martin Klein, was remanded to the custody of Antelope County sheriff Bob Moore for execution of the prison sentence.

Johnson extended probation an additional six months for Daylynna S. Robertson, 51, of Oakdale, effective April 30. Additional fees were waived.

Robertson was sentenced to 12 months probation in April 2020 for a felony conviction of possessing a controlled substance. Johnson signed the order last month, at the request of her probation officer. She was also ordered to serve custodial sanctions in the county jail in March after testing positive for marijuana and methamphetamine.
