2016 Holt County case resolved with fines

Natasha R. Destin, 30, of Houston, Texas, was allowed by the Honorable Kale Burdick to resolve a 2016 Holt County court case by waiver. She pleaded guilty to four counts on an amended complaint filed by Holt County attorney Brent Kelly on Sept. 17, Count I, operate vehicle during time of suspension, a Class 3 misdemeanor (reduced by Kelly, from a Class 2 misdemeanor, driving during revocation); Count II, possession of marijuana, an infraction; Count III, no operator’s license on person, a Class 3 misdemeanor; and Count IV, possession of drug paraphernalia, an infraction.

She was fined $300 on Count I and ordered to reimburse the county $17 of $402 bond forfeiture; fined $300 on Count II; $25 on Count III; and $100 on Count IV.

Destin was arrested Feb. 10, 2016, after a traffic stop in O’Neill. She posted bond in the amount of $5,000, 10% cash the same day. She failed to appear for arraignment March 23, 2016. A warrant was issued with new bond set at $5,000, 10%, and the original bond she posted was declared forfeited. Subsequent warrants were issued March 8, 2018, and March 3, 2020.

Daniel D. Krivolavek, 22, of Inman faced Burdick in the Holt County courtroom last Tuesday, Sept. 22, on Count I, attempt of a Class 1 felony, a Class 1 misdemeanor; and Count II, possession of drug paraphernalia, an infraction. Krivolavek pleaded guilty to the crimes committed May 16. Burdick sentenced him to fines of $500 and $100, respectively, and taxed $50 costs of prosecution. Count I was amended by Kelly, from a Class 4 felony charge of possession of a controlled substance.

Krivolavek was represented by Holt County public defender Rod Smith of O’Neill.

Jadelyn J. Limburg, 18, of Inman faced Burdick on Count I, attempt of a Class 1 felony, a Class 1 misdemeanor; and Count II, possession of drug paraphernalia, an infraction. Limburg pleaded guilty to the crimes committed May 16. Burdick sentenced Limburg to fines of $500 and $100, respectively, and $50 costs of prosecution. Count I was amended by Kelly, from a Class 4 felony charge of possession of a controlled substance.

Limburg was represented by court-appointed attorney, Ashley Boettcher of O’Neill.

Roger “Ray” Hauf, 18, of O’Neill faced Burdick for sentencing on a count of driving under the influence of alcohol, first offense. Burdick sentenced him to a $500 fine; a six-month term of probation, including $210 program fees; revoked his driver’s license for 60 days and assessed $55 costs of prosecution. Hauf had pleaded guilty to the Jan. 20 offense as part of a plea deal. In return, Kelly dismissed three additional counts, possession or consumption of alcoholic liquor by a minor, a Class 3 misdemeanor; open container violation, an infraction; and a stop sign violation, also an infraction.

Hauf was represented by Smith.

Diblan E Cortez Hernandez, 23, of Norfolk faced Burdick for further arraignment on two counts, Count I, operating a vehicle during revocation, subsequent offense; and Count II, no valid registration, both Class 3 misdemeanors. Cortez Hernandez pleaded guilty, via interpreter, to Count I, pursuant to a plea agreement. In return, Kelly dropped Count II and recommended a fine only.

Burdick fined him $100 and taxed him $50 costs.

Cortez Hernandez was represented by Forrest Peetz of O’Neill. Maria Chavez served as interpreter.

Erminio Cifuentes Solis, 40, of O’Neill appeared for further arraignment on a count of driving during revocation, a Class I misdemeanor. Pursuant to a plea deal, the charge was reduced to driving under suspension/before reinstated, a Class 3 misdemeanor, and there was a joint recommendation for a fine only. Cifuentes Solis pleaded guilty to the Jan 28 offense. Burdick sentenced him to a $200 fine and assessed $50 costs.

He was represented by Smith and Chavez interpreted.

Bruce E. Erickson, 79, of Inman pleaded no contest to an amended count of careless driving, an infraction committed July 12. Burdick found him guilty. Erickson was fined $100 and taxed $67.50 costs of prosecution.

The original charge of reckless driving, a Class 3 misdemeanor, was reduced by Kelly. Erickson was represented by Kathleen Rockey of Norfolk.

James L. Palik, 19, of O’Neill pleaded guilty, by waiver, to four infraction counts of possession of drug paraphernalia. He was fined $100 on each charge and $49 costs. The offenses were committed Aug. 10 in O’Neill.

Cody L. Crisler, 18, of O’Neill pleaded guilty, by waiver, to four infraction counts of possessing drug paraphernalia. He was fined $100 for each Aug. 10 offense and $49 costs.

Chad A. Doiel, 44, of Atkinson pleaded guilty by waiver to misdemeanor charge of violating a City of Atkinson ordinance that prohibits barking and offensive dogs. He was fined $25 and $49 costs for the June 4 offense.
