Woman sentenced for 2018 hit and run in O'Neill

The Honorable Kale Burdick handed down one sentence in the Holt County courtroom in O'Neill last Tuesday, Nov. 12

Eliza F. Sutton, 37, of Columbus faced Burdick for arraignment on four counts, Count I, willful reckless driving, a Class 3 misdemeanor; Count II, driving during revocation, a Class 2 misdemeanor; Count III, open alcohol container, an infraction; and Count IV, leave scene of accident, fail to provide information, a Class 2 misdemeanor. Pursuant to a plea agreement with county prosecutor Brent Kelly, Sutton pleaded no contest to counts II, III and IV and Kelly dismissed Count I. Burdick sentenced the defendant to pay $250 fines each on Count II and Count IV, $50 on Count III and $50 costs. The case dates to a hit and run accident Dec. 1, 2018, in O'Neill. The defendant failed to appear Feb. 19 and a warrant was issued for her arrest. She again failed to appear Sept. 17, and then was granted continuances Oct. 1 and Nov. 5.

Mark Faust, 58, of LaVista pleaded guilty and was sentenced by Burdick on Nov. 5, to a six-month term of probation for a conviction of driving under the influence of alcohol, first offense, and failure to signal, both committed July 2 in O'Neill. The probation order includes fines of $525, costs and fees totaling $315 and his driver's license was revoked for 60 days. He was arrested after two reports were made to the Holt/Boyd 911 Dispatch Center, from personnel at Avera St. Anthony Hospital, that he had left the facility in his pickup and was suspected to be intoxicated.

Francis L. Brundle, 32, of Page was sentenced to pay a $100 fine, $250 restitution and $50 costs for a conviction of criminal mischief, a Class 3 misdemeanor committed Aug. 25.

Ariane J. Rutter, 19, of Osceola pleaded guilty by waiver and was sentenced to a $100 fine and $49 costs for possession of drug paraphernalia, an infraction committed Oct. 8.

James Bertling, 46, of Baytown, Texas, pleaded guilty by waiver and was sentenced to a $25 fine and $49 costs for a permit violation, having no escort vehicle as required. He was cited Oct. 10.

Anthony Bowman, 45, of Poteet, Texas, pleaded guilty by waiver and was sentenced to a $25 fine and $49 costs for a permit violation, having no escort vehicle as required. He was cited Oct. 10.
