Many court cases continued, other defendants skip

Two defendants were arraigned in the Antelope County courtroom in Neligh recently, while, in the wake of a pending winter storm, many either had their appearances continued to February or just didn’t show up. One defendant had his case dismissed.

Austin R. Bertschinger, 30, of Oakdale appeared in front of the Honorable Donna Taylor on Jan. 18 for arraignment on a count of possession of tramadol, a Class 4 felony alleged Dec. 10.

Bertschinger requested court-appointed counsel. After holding an indigency hearing, Taylor appointed Antelope County public defender Pat Carney of Norfolk. Further arraignment was set Feb. 1. Bond posted Dec. 28, in the amount of $1,000, 10% cash, was continued as well.


Bertschinger was arrested Dec. 10 by an Antelope County deputy, on the Madison-Antelope County line near Tilden, after a bottle of Tramadol was allegedly found in the purse of a passenger during a search of his vehicle. According to a probable-cause affidavit filed by the officer, Bertschinger allegedly claimed the drug and told officers it was given to him by his grandmother for a dog bite he had suffered the previous day.


Timothy D. Anderson, 66, of Neligh appeared for arraignment on a Class 2 misdemeanor, leaving scene of property-damage accident, committed Oct. 28, 2022. Anderson pleaded guilty and Taylor set sentencing Feb. 15. Anderson was ordered to obtain an alcohol/drug evaluation from a certified counselor. He is represented by Carney.

Adam M. Babl of Norfolk appeared for pretrial hearing on two counts, no proof of financial responsibility, a Class 2 misdemeanor and no valid registration, a Class 3 misdemeanor, both alleged June 18, 2022. Deputy Antelope County Attorney Joe Smith dismissed both counts without prejudice. Babl, who was represented by Carney, was taxed $49 costs.

Bobbi S. Jenkins, 38, of Plainview appeared for pretrial hearing on two counts alleged July 12, no proof of financial responsibility, a Class 2 misdemeanor, and traveling on a closed road, an infraction. Taylor sustained a defense motion to continue. Pretrial is continued to Feb. 15. Jenkins is represented by Carney.

Taylor continued felony first appearances and misdemeanor arraignments for several more defendants:

• Morgan K. Anson, 24, Orchard, first hearing continued to Feb. 1 on a Class 2A felony, theft by receiving stolen property and three Class 4 felonies, possession of methamphetamine, operating a motor vehicle to avoid arrest and possession of burglar tools, all alleged Dec. 9, 2022; motion filed to revoke bond posted Dec. 20, 2022, in the amount of $50,000, 10%;

• Sarah J. Ward, 46, Oakdale, first hearing continued to Feb. 1 on Class 4 felony, possession of controlled substance (methamphetamine) alleged Jan. 4; bond in amount of $20,000, 10% cash, posted Jan. 10, is also continued;

• Breanna M. McNutt, 22, Norfolk, hearing continued to Feb. 1 on allegations of probation violation;

Barbara Youngblood, 42, O’Neill, pretrial hearing continued to Feb. 15 on Count I, third-degree assault, a Class 1 misdemeanor, and Count II, disturbing the peace, a Class 3 misdemeanor, both alleged Sept. 24, 2022;

Maverick Short, 18, Oakdale, pretrial hearing continued to Feb. 1 on two counts, Count I, driving under the influence of alcohol (high test), a Class W misdemeanor, and MIP, a Class 3 misdemeanor, both alleged Oct. 1, 2022; $1,500 personal recognizance bond also continued;

• Roscoe L. Wallace, 55, Sioux City, Iowa, arraignment continued to Feb. 1 on possession of marijuana, an infraction alleged Dec. 10, 2022;

• Tanai R. Zlomke, 32, Verdigre, arraignment continued to Feb. 1 on possession of drug paraphernalia, an infraction alleged Dec. 10;

Michael Hansen, 36, Stanton, arraignment continued to Feb. 1 on Class 1 misdemeanor alleged Nov. 26, 2022, obstruct government operations;

Ron Crumly, 74, Page, arraignment continued to Feb. 1 on Class 4 misdemeanor alleged March 1, 2022, violation of statewide burn ban;

Randi Mack, 35, Elgin, arraignment continued to Feb. 1 on three counts of issuing bad checks, 0 to $500, alleged in July and August 2022;

Jessica Scott, 42, Clearwater, arraignment continued to Feb. 1 on two counts of issuing bad checks, 0 to $500, alleged in May and August 2022;

• Earleen F. Jensen, 81, Royal, arraignment continued to Feb. 15 on count of maintaining a dangerous building, alleged in November 2022 (Village of Orchard);

• Jay A. Pettijohn, 63, Royal, arraignment continued to Feb. 15 on count of maintaining a dangerous building, alleged in November 2022 (Village of Orchard);

Jennifer Trease, 54, Orchard, arraignment continued to Feb. 15 on count of maintaining a dangerous building, alleged in November 2022 (Village of Orchard);

Several defendants failed to appear for their scheduled hearings Jan. 18 and Taylor ruled the county attorney may file motions, affidavits and orders for arrest warrants. Defendants who did not show up in court include:

• Clifton J. Coleman, 28, Porcupine, South Dakota, arraignment for possession of open alcohol container, an infraction alleged Nov. 23, 2022;

Lance Carlson, 54, Broken Bow, arraignment on two Class 2 misdemeanor counts of issuing bad checks, 0-$500, alleged Sept. 14, 2022;

James Greenhalgh, 43, Tilden, arraignment on issuing a bad check, 0-$500, alleged Jan. 9, 2022;

• Donaven F. Nolze, 22, Clearwater, arraignment on issuing a bad check, 0-$500, alleged in July 2022;

• Tricia A. Zobrist, 43, Oakdale, arraignment on issuing a bad check, 0-$500, alleged in December 2021; and

Cassandra Thomson, 39, Lynch, arraignment on issuing a bad check, 0-$500, alleged July 7, 2022.
