Justin M. Golter, 47, of Orchard appeared in the Antelope County courtroom Nov. 16 on charges alleged Aug. 31 in two cases. He was set for preliminary hearing on a Class 1D felony, possession of methamphetamine, with intent to deliver, more than 10 grams and for pretrial hearing on three Class 1 misdemeanors in the other case, resisting arrest, obstructing officers and obstructing government operations.

Taylor granted a defense request to continue the preliminary hearing on the felony to Dec. 7.

A plea deal was announced in the misdemeanor case. In return for Golter’s guilty plea to resisting arrest, Antelope County Attorney Joe Abler recommended a jail sentence of 78 days already served and dismissed the other two counts.

Abler said he offered the plea deal for “a couple different reasons…to get this cleared up for him so it isn’t a detainer when he is sent to the Nebraska Department of Corrections.”

Golter is set for sentencing in Antelope County district court Nov. 30 on his conviction of possession of meth with intent to deliver, more than 10 grams (two ounces equal to 56.699 grams), a felony committed in August 2020.

Taylor sentenced Golter to 77 days in the Antelope County Jail and applied the extra day toward costs.

The judge also addressed bond since $50,000 bond in the misdemeanor case was exonerated. No bond was set in the 2022 felony case, although Judge Mark Johnson set a $250,000, 10% bond in the district court case after Golter’s August flight.

“Judge Johnson set bond high enough, I don’t anticipate Mr. Golter going anywhere,” Abler said.

Taylor then questioned the continuance that she had approved for the preliminary hearing in the most recent felony case.

“We set preliminary hearing for Dec. 7,” she said. “If he gets sentenced (in district court) Nov. 30, you won’t have him anymore.”

Abler said he would let her know.

Golter, who was out on bond in the district court case, ran from the courthouse Aug. 31 after he was ordered to produce a urine specimen for drug testing, leading Moore and a deputy on a foot chase before he was taken into custody several blocks away.

Golter was remanded to Moore’s custody, pending posting of bond in the district court case. He is represented by Antelope County public defender Pat Carney of Norfolk.

Bobbi S. Jenkins, 37, of Plainview appeared for pretrial hearing on two counts alleged July 12, no proof of financial responsibility, a Class 2 misdemeanor, and traveling on a closed road, an infraction. The hearing was continued to Dec. 7 at Abler’s request. He first asked for a delay so he could determine if a potential witness was in the courthouse. He was advised by the court clerk that the subpoena for the witness had been returned as “unservable, bad address.”

Aaron C. Poellot, 38, of Osmond appeared for pretrial hearing. Poellot is charged with a Class 2 misdemeanor theft count related to a May 2 gas drive-off from Royal One Stop. Carney requested continuance, citing need for more evidence, but asked that a trial date be set.

“If there is still evidence…I am not going to set a jury trial,” Taylor said. She continued the pretrial hearing to Dec. 28.
