BOARD OF TRUSTEES

March 14, 2022

The Board of Trustees of the Village of Clearwater met in regular session Monday, March 14, at 8 p.m., in the fire hall meeting room. Meeting opened at 8 p.m. Notice of Meeting was given in advance by publication in Summerland Advocate-Messenger and notice was given to board members prior to meeting. Public was informed of location of Open Meeting Act poster.

Present: Kevin Filsinger, Kelly Kerkman, Steve Hankla, Cody Kester, Steve Stearns. Others present: Kate Ahlers, Kyle Petersen, LuAnn Schindler, Lauren Sheridan-Simonsen, Curt Thiele, Bill Thiele, Miaha Scott, Daryl Guthard.


Approved regular minutes and treasurer’s report for February.

Approved nomination of Cody Kester to fill board of trustees vacancy. Kester took the oath of office.


Late water bills presented.

Miller & Associates report presented. Progress is being made, but still waiting for lift station parts. If not completed soon, village will have to irrigate old lagoon so it doesn’t overfill.

Approved paying Cornerstone Bank interest payment of $37,000, pending USDA approval.

Read two bids to hay village properties during 2022 mowing season. Approved bid of $2,000 from Jay Snider. Denied bid of $1,500 from Eli Jacob.

Voted against selling southern portion of park for housing development.

Voted against Ordinance 2022-4, authorizing survey of southern portion of park.

Approved special liquor license for Clearwater Chamber at rodeo grounds during rodeo June 24-26.

Approved special liquor license for American Legion for Main St. dance and concert June 24 and 25. Kerkman abstained.

Approved waiving three readings of Ordinance 2022-5 that became Ordinance 2022-4, prohibiting portable storage in residential areas.

Approved moving agenda item 24, discussion with Bud’s Sanitary Service. Discussion held regarding price increase of $1.25 and how to pass it to customers. Contract signed in October 2021 for two years, will now need new contract. Also discussed how to handle customers who own businesses and residences in town and that the village has not charged both in past. Approved postponing any decisions until April meeting.

Approved postponing Ordinance 2022-6, increasing trash service rates, until April meeting.

Approved paying Tip Top Lawn Care $1,690 for four applications of weed spray and fertilizer around park.

Approved moving agenda item 21, building permit application for Miaha Scott. Approved building permit of Miaha Scott.

Economic development report presented.

Approved paying approximately $160 to give graduating Clearwater seniors a mailbox to remind them to return home.

Approved paying 25% of the cost of CEC Conference for Lauren Sheridan-Simonsen to attend.

Maintenance, library, park, sheriff’s and clerk’s reports presented.

Discussion held regarding letters to community for cleanup and include services available. Approved getting public roll-off dumpster for month of May. Kyle Petersen discussed LB256 a vacant/dilapidated property cleanup statute and how Clearwater can adopt it.

Approved going into executive session to discuss potential litigation and Bud’s Sanitary contract at 9:39 p.m.

Approved exiting executive session at 10:10 p.m.

Approved claims and payroll. Claims: $79,523.78; wages: $3,920.51

Meeting adjourned at 10:22 p.m.
