Agreements reached in Antelope county district court

 


Plea bargains were announced in two Antelope County district court cases last Wednesday, May 26, when the Honorable Mark Johnson presided from the bench of the courtroom in Neligh.

Michael G. Loy, 51, of Elgin faced Johnson for a pretrial hearing on a felony count of driving under the influence of alcohol, (.15 grams or more) and an infraction open container violation.

A plea deal was announced. Antelope County prosecutor Joe Abler reduced the felony DUI charge to to a Class W misdemeanor count, DUI, less than .15 grams, first offense, and dismissed the open container count in return for Loy’s guilty pleas. Abler also agreed not to oppose probation, if a presentence investigation reflected the same.


Johnson found Loy guilty on both counts and set sentencing July 28. Bond, in the amount of $25,000. 10% cash, posted March 18, is continued.

Loy is represented by public defender Patrick Carney of Norfolk.

Gregory Mott, 53, of Tilden appeared for a pretrial hearing on Count I, terroristic threats, a Class 3A felony and Count II, third-degree domestic assault, a Class 1 misdemeanor.

A plea deal was reached, with Abler dismissing the felony count, agreeing to file no additional charges in the case and not to oppose probation, if PSI

reflects the same, all in return for Mott’s guilty plea to Count II. Mott entered the guilty plea to Count II and Johnson found him guilty of the Dec. 18 crime, setting sentencing for July 28. Bond, posted Dec. 21, 2020, in the amount of $10,000, 10%, is continued, with a condition for no contact with the victim, direct nor indirect.

He is represented by Carney. Two defendants appeared for arraignment, with pretrial hearings set June 30 and jury trials on July 13.

Tyler J. Napier, 31, currently held at the Antelope County Jail, appeared on two counts of strangulation and one count of terroristic threats, all Class 3A felonies, and two Class I misdemeanor charges, third-degree assault.

He entered not guilty pleas to all five counts alleged April 30.

Bond is continued in the amount of $250,000, 10%. Johnson ordered he have no contact, direct nor indirect, with the alleged victims, nor to be at 83646 524 Avenue, Elgin.

Napier is represented by Martin Klein of Neligh. He was remanded to the custody of Antelope County sheriff Robert Moore, pending posting of bond.

Andrew D. Herley, 20, of Neligh appeared for arraignment on a Class 2A felony count, possession of a stolen firearm. Herley pleaded not guilty. Bond posted May 4 in the amount of $5,000, 10%, is continued, with modification allowing him to leave the country June 1-5, for a family wedding. He is represented by Carney.
