Probation revoked, Stuart man sentenced to six months in jail

Kyle R. Boettcher, 30, of Stuart faced the Honorable Mark Kozisek on Sept. 14 for resentencing after his probation was revoked.

Kozisek ordered Boettcher serve 180 days in the Holt County Jail, with credit allowed for 65 days previously served. In addition, he was fined $100, taxed court costs of $75.82, in addition to the original $147 assessed last year, and accrued probation costs of $330.

Boettcher was remanded to the custody of the Holt County sheriff.

Boettcher admitted nine of 10 violations pursuant to a plea deal with county prosecutor Brent Kelly last month, including his arrest on three counts in July (charges pending in Holt County court); failure to appear for scheduled probation meeting; failure to obtain employment; possession of methamphetamine and drug paraphernalia; failure to report for drug test; failure to obtain chemical dependency evaluation; failure to make payments to the court; and failure to attend employment or relapse prevention classes. He did not admit an alleged violation of association with an individual with a known criminal history.


In October 2019, Boettcher was sentenced to 18 months of probation for a Class 4 felony conviction possession of a controlled substance, lorazepam. He was also fined $100 on a count of possession of drug paraphernalia. A count of theft by receiving stolen property was dismissed as part of an earlier plea agreement.

He had previously served a total of 56 days in custodial sanctions for violations committed, beginning in November 2019 and continuing through June 11.

Boettcher was represented by public defender Rodney Smith of O’Neill.
